Supreme Court in India is the ultimate body to implement actions that are best in the interests of its citizens.

Following its same concerning nature, the apex body in a new guideline has made it compulsory for the dealers to provide a helmet for every new-fangled bike sold.

To give you a tip-off about this whole episode, way back in July, 2009, the Delhi high court has made it compulsory the same decision we are talking about.

However, the court’s decision was protested by the society of Indian automobile manufacturers (SAIM) quoting the restriction on the freedom of people to buy a helmet of their choice. The new rule shall also add to the cost of a brand new bike.

Even after the tangible blemish facts in the new rule, the Supreme Court has given green signal to implement the mentioned rule with immediate force to buy a new helmet with every new bike a customer plans to own.

The rule also states that the helmets being provided with new two-wheelers to be of Bureau of Indian Standards (BIS) tags only and to be provided through a recognized dealer only.

The surprising thing is that most cities in India have not implemented the rule which makes it compulsory for the rider and pillion to wear a helmet while commuting on a two wheeler. Even though such a law is present in cities like Mumbai, the commuters use the helmet to save themselves from the cops instead of saving their lives from a probable mishap.

An automobile dealer stated on the demerits of the new rule on the condition being unnamed.

Let there be more helmets. When you are buying a second scooter of Rs.40, 000, then you can buy a helmet also, which is of Rs.300 only”. This move makes it mandatory for the makers to sell helmets along with every two wheeler they sell which in turn means extra expenses on the buyer.

The Supreme Court, which is firm on its decision stated.

All controversies concerning the decision kept aside, the new law shall inspire and encourage new bikers and less aware ones to wear the helmets since they have paid for the same (Be it forcefully)

The very move of the court is a right one surely for a longer term view, if implemented in its truest senses.

Nevertheless, the quality of the helmets which would be provided remains a pivotal issue to keep an eye on.
